Terms and Conditions

These Terms and Conditions ("Terms") govern your use of Afomo ("Platform", "we", "our", "us"). By accessing or using Afomo, you agree to be bound by these Terms.

If you do not agree, do not use the Platform.

1. Eligibility and Account Registration

  1. You must provide accurate, current, and complete information when creating an account.
  2. You are responsible for safeguarding your login credentials and wallet PIN.
  3. You are responsible for all activity under your account.
  4. We may request identity and KYC information as required for compliance and risk control.

2. Marketplace Role

  1. Afomo operates as a marketplace connecting buyers and independent third-party sellers.
  2. Afomo is not the owner of all goods listed by sellers and is not automatically the direct seller of listed products.
  3. Sellers are responsible for listing accuracy, lawful goods, and fulfillment obligations.

3. Orders and Payments

  1. Orders are subject to seller acceptance, availability, and platform checks.
  2. Supported payment methods may include wallet, gateway payments, pay-on-delivery, and approved alternatives.
  3. For eligible digital transactions, settlement to sellers may be delayed pending delivery confirmation, policy checks, or active dispute status.
  4. Payment verification, webhook confirmation, and anti-fraud controls may be applied before final processing.

4. Wallet and Funding Features

  1. Wallet features are provided for platform-related commerce transactions.
  2. Users must protect wallet PINs and may be required to complete verification before higher limits or certain actions.
  3. We may apply limits, holds, or restrictions based on account tier, security events, or compliance obligations.

5. Seller Obligations

Sellers agree to:

  1. List only legal products and truthful descriptions.
  2. Honor order commitments and shipping timelines.
  3. Comply with all applicable laws and platform policies.
  4. Provide requested KYC/compliance information.
  5. Refrain from off-platform arrangements that bypass platform protections and controls.

6. Buyer Obligations

Buyers agree to:

  1. Place legitimate purchase orders in good faith.
  2. Provide accurate delivery and contact details.
  3. Use dispute channels honestly and submit genuine evidence.
  4. Avoid abusive refund/dispute behavior.

7. Prohibited Use

You must not use Afomo for:

  1. Illegal, fraudulent, or deceptive conduct.
  2. Money laundering, terrorist financing, or evasion of compliance controls.
  3. Sale of prohibited or restricted goods.
  4. Security abuse, scraping, malware injection, or unauthorized access attempts.

8. Disputes, Refunds, and Resolution

  1. Buyers may raise disputes according to platform procedures.
  2. Sellers can respond and provide evidence.
  3. Unresolved matters may be escalated for review.
  4. Outcomes may include full/partial refund, replacement, release to seller, or other policy-permitted action.
  5. Refund handling follows the Refund Policy and payment method constraints.

9. Fees and Charges

  1. Platform fees, commissions, and processing conditions may apply as disclosed in product or transaction flows.
  2. We may update pricing/fee structures with notice where required.

10. Intellectual Property

  1. The Afomo brand, platform software, and service content are protected by applicable intellectual property laws.
  2. Users retain ownership of their lawful content but grant us a limited license to host, process, and display such content for platform operations.

11. Suspension and Termination

We may suspend, restrict, or terminate access where we detect:

  1. Breach of these Terms or any policy.
  2. Fraud, abusive activity, or suspicious transactions.
  3. Legal or regulatory risk requiring immediate action.

Where appropriate, we may also remove listings, hold settlements, or reverse actions subject to law and policy.

12. Disclaimers

  1. The Platform is provided on an as-available and as-is basis to the extent permitted by law.
  2. We do not guarantee uninterrupted, error-free service at all times.
  3. Third-party provider outages or failures may affect some features.

13. Limitation of Liability

To the extent permitted by law, Afomo and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages arising from platform use.

Nothing in these Terms excludes liability that cannot be excluded by applicable law.

14. Indemnity

You agree to indemnify and hold Afomo harmless from claims, losses, or liabilities arising from your violation of these Terms, misuse of the Platform, or infringement of third-party rights.

15. Governing Law and Jurisdiction

These Terms are governed by applicable laws of the Federal Republic of Nigeria, unless otherwise required by mandatory law. Disputes shall be handled in competent courts or lawful dispute channels with jurisdiction.

16. Changes to Terms

We may update these Terms periodically. Continued use of the Platform after updates constitutes acceptance of revised Terms.
